Terms and Conditions for the Law Office of Yoel Molina, P.A.

 

1. Acceptance of Terms

By engaging the services of the Law Office of Yoel Molina, P.A. (hereafter referred to as "the Firm"), or by submitting payment for any services rendered, both the client (hereafter referred to as "Client") and the Firm agree to be bound by these Terms and Conditions, regardless of any prior representation or agreements. These Terms apply to all engagements between the Client and the Firm and govern the provision of legal services provided by the Firm.

Upon initiating services, the Client will receive an engagement email from the Firm, outlining the scope of legal services, fee structure, and other relevant details. Acknowledgment of this email is required to proceed with the legal representation.

2. Legal Services

a. The scope of legal services to be provided shall be expressly agreed upon in writing between the Client and the Firm.

b. The Firm agrees to provide legal services in a professional and timely manner, consistent with industry standards and in compliance with applicable laws and ethical duties.

3. Client Responsibilities

a. The Client agrees to cooperate with the Firm, provide necessary documentation in a timely manner, and follow the Firm’s advice and recommendations regarding legal matters.

b. The Client agrees to inform the Firm promptly of any changes in circumstances that may affect their legal matter.

4. Confidentiality

a. The Firm will maintain the confidentiality of all Client information as required by law and legal ethics.

b. Confidential information will not be disclosed unless required by law or with the Client’s express consent.

5. Fees and Payment

a. The Client agrees to pay fees as detailed in the engagement email and any subsequent fee agreement provided by the Firm.

b. Payment is due upon receipt of invoice, unless otherwise agreed in writing. By submitting payment, the Client confirms their acceptance of these Terms and Conditions, irrespective of any previous agreements or understandings.

c. A fee of $100.00 will be charged for any bounced check or reversed or failed credit card or ACH transfer.

d. Late payments may incur additional charges. 

e. In the event that any fees or costs remain unpaid and the Firm initiates collection efforts, the Client shall be responsible for all associated collection costs, including but not limited to attorney's fees, court costs, and collection agency fees.

6. Conflict of Interest

a. Prior to the commencement of any work, the Firm will perform checks for any potential conflicts of interest.

b. If a conflict of interest arises during the representation, the Firm may be required to cease representing the Client according to the applicable ethical rules.

7. Termination of Services

a. The Client may terminate the legal services at any time for any reason. However, the Client remains responsible for any fees and expenses incurred up to the date of termination.

b. The Firm may withdraw from providing services with reasonable notice to the Client and in compliance with legal ethics.

8. Limitation of Liability

a. The Firm's total liability for any claims arising out of or related to the services provided under these Terms, whether in contract, tort, or otherwise, shall be limited to the amount of fees actually paid by the Client for the services from which the claim arose.

9. Dispute Resolution

All disputes arising under these Terms shall be resolved exclusively through binding arbitration conducted by the American Arbitration Association, in accordance with its commercial arbitration rules. No litigation shall be initiated in any court except to enforce an arbitration award.

10. Modifications to Terms

The Firm reserves the right to modify these Terms at any time. Continued engagement by the Client after such modifications constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida. Exclusive jurisdiction for any legal matters shall reside in Miami-Dade County.
